Income Determinations

The courts will determine the amount of income earned by a party when addressing the issues of child support and spousal maintenance.  If a party is not working full-time, the court will decide whether that party has the ability to work full-time and, if so, will determine their income based upon their potential earnings.  The court will also determine whether to include a party’s bonus, commissions, or overtime income.  Determining a self-employed person’s income requires detailed documentation and complex calculations.
